Terms of Service
Last updated: [PENDING] · Effective date: [PENDING]
1. Acceptance of terms
By creating an account, starting a free trial, or otherwise using Little Learners (the "Service"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service.
These Terms form a legally binding agreement between you and [LEGAL ENTITY NAME], the operator of Little Learners.
Final version to specify the legal entity, its jurisdiction of incorporation, and registered address.
2. Your account
To use Little Learners you must:
- Be at least 18 years old, or the age of majority in your jurisdiction
- Provide accurate and current information when you sign up
- Maintain the security of your password and account
- Be responsible for all activity that happens under your account
You may not share your login credentials with anyone outside your immediate family, or transfer your account to another person.
3. Children's accounts & parental responsibility
Little Learners is designed for children K through 5th grade. Children do not create their own accounts. Each child profile is created and managed by the parent or legal guardian who owns the subscribing account.
3.1 Parental consent
By creating a child profile, you represent and warrant that you are the parent or legal guardian of that child and that you consent to our collection and use of the child's information as described in our Privacy Policy.
3.2 Supervision
You are responsible for supervising your child's use of the Service. While we work to keep all content age-appropriate, you should review activity periodically through the Parents Corner.
3.3 Multiple children
One subscription covers all child profiles under a single account. There is no per-child fee. We do not impose a hard cap on the number of profiles, but we reserve the right to investigate accounts that appear to be shared across multiple households.
4. Subscriptions, free trial, billing
4.1 Free trial
New accounts may begin with a 3-day free trial. A valid payment method is required to start the trial. If you do not cancel before the end of the trial period, your subscription will begin automatically and your payment method will be charged at the rate of the plan you selected.
4.2 Plans and pricing
- Monthly: billed once per month at the then-current monthly rate
- Annual: billed once per year at the then-current annual rate, which reflects the equivalent of two months free compared to monthly billing
Prices are listed on the Pricing page and may change with notice. Existing subscribers will continue to pay their current rate until renewal.
4.3 Automatic renewal
Subscriptions renew automatically at the end of each billing period unless cancelled. You can cancel any time from your account settings.
4.4 Payment processing
Payment is processed by Stripe, our payment processor. We do not store your full payment card information on our servers. Stripe's terms and privacy policy apply to your payment data.
Final version to specify exact handling of failed payments, grace periods, dunning emails, and taxes (sales tax, VAT, GST) by jurisdiction.
5. Cancellation and refunds
5.1 How to cancel
You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period. Your access to the Service continues until that date.
5.2 Refunds
We do not provide refunds for partial billing periods. If you cancel mid-month or mid-year, your subscription remains active until the period ends.
5.3 Free trial cancellation
If you cancel before the end of your 3-day free trial, you will not be charged. After the trial converts to a paid subscription, the standard cancellation policy applies.
Final version to address consumer-protection rights in EU/UK (14-day cooling-off period), and refund policies for specific US states that require them.
6. Acceptable use
You agree not to:
- Reverse engineer, decompile, or attempt to extract source code from the Service
- Scrape, harvest or otherwise extract content from the Service in bulk
- Use the Service to violate any law or infringe anyone's rights
- Use the Service to harass, defraud, or harm anyone
- Interfere with the Service's operation or security
- Share account access with people outside your immediate family
- Resell, sublicense, or commercially exploit the Service
7. Content and intellectual property
7.1 Our content
All practice questions, hints, explanations, illustrations, design, and software in the Service are the property of Little Learners or our licensors. We grant you a limited, non-exclusive, non-transferable license to access and use the Service for personal, family use only.
7.2 Your content
You retain ownership of any content you submit (such as child names, avatar choices, or feedback). By submitting it, you grant us a license to use it as needed to operate the Service.
7.3 Trademarks
"Little Learners" and the LL logo are trademarks of [LEGAL ENTITY NAME]. You may not use them without our written permission.
8. Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or meet your specific educational goals.
While we align content to widely-used standards (such as MAP Growth, NGSS, and Common Core), the Service is a supplement to, not a replacement for, school instruction. We do not guarantee any specific learning outcome or test score improvement.
Final version to include any state-specific or country-specific warranty disclosures required (some jurisdictions limit how broadly disclaimers can be drafted).
9. Limitation of liability
To the maximum extent permitted by law, Little Learners and its affiliates will not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages arising from or related to your use of the Service.
Our total cumulative liability to you for any claims arising from these Terms or the Service is limited to the amount you paid us in the 12 months preceding the claim.
Some jurisdictions do not allow these limitations, in which case the limitations apply to the maximum extent allowed.
10. Termination
We may suspend or terminate your account if you breach these Terms, fail to pay, or use the Service in a way that risks harm to children, other users, or the Service itself.
You may terminate your account at any time by cancelling your subscription and contacting us to request deletion of your data.
11. Governing law and disputes
These Terms are governed by the laws of [JURISDICTION], without regard to conflict of laws principles.
Final version to specify the governing state/country, dispute resolution (arbitration vs courts), small-claims carveouts, class-action provisions, and venue.
12. Changes to these terms
We may update these Terms from time to time. When we make material changes, we will notify you by email and post the updated Terms here with a new "Last updated" date. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
